no, its the point that they did not send me the card that was advertised, and continues to be advertised on their website. and i believe that i do have a right to receive the product that i intended to purchase... i did not and newegg continues to perpetrate this fraud by not updating their website... though i did make them aware of the website so maybe that will change... honestly what would most of you do if you paid for something.. got the wrong thing, on top of that find out that the wrong thing is inferior to what you intended and did purchase.... how would you deal with that... i guarantee if you were in my place you would be pretty mad. its not that they sent me just some revision.. .they sent me a completely different card... so i am not going to accept that and neither would anyone with the least amount of balls.

that is their website... if you looke you will see a refurb. sapphire 9800, two more down you will see a ati sapphire 9800. the ati card is what i order, what i got was a sapphire 9800. two distinctly different cards... even according to their website. can you not see how this is wrong?
sheeesh calm down people. newegg isnt guilty of jack squat besides a bit of ignorance. definitely not fraud. like titus said, on the site they differentiate between the sapphire oem and the sapphire ati oem so they acknowledge the difference.
as far as returning the card goes, im in the same boat as titus and im going to refuse that pack of $hit and get a refund. most people on these forums are very much into the technology they buy. they do research etc and come up with a specific product with specific characteristics that they want. it's not about 300 points in some benchmark. it's not about overclocking potential. it's about getting EXACTLY what you paid for.
i know if i had bought my 1700+ and it had turned out to be a different stepping than that advertised (@GameVE) i would've raised all kinda hell. turns out it does 2.35Ghz @ 1.85V on air :D
I'm even more confused. I saw ONE Sapphire NON-PRO that wasn't an SE on that newegg link. Is this a Pro or np?? The 'refurb' directions all pointed to Pros....if an SE was received, then there's no case at all - it's completely obvious that newegg was wrong - but that wasn't stated....
Plus, people were getting a bit up in arms PRECISELY because of the claims of newegg fraud.
Maybe it's me, but I'm STILL not 100% sure which card was ordered and which one was received.
they have since sold out of the refurb. sapphire 9800.. but it was up. they only reason i say anything about fraud is cause they still have yet to change their website to reflect what they are truely selling. now i am not sure that this is an oversight and i am not claiming that they are intentionally perpetrating a fraud, but it is suspect to me that they have had 4 days to correct this problem.. i have even told them of the problem and they have not fixed it. so it does make me wonder just what is going on.

subtle differene in naming, but a vastly different product. i.e. the ati sapphire has the red pcb and performs on par with other 9800np
the sapphire ati oem 9800np has black pcb and has subpar performance

You should leave a review at Newegg for the Sapphire 9800 np and tell everyone what's going on, tituswolf. Not everyone looks around at these forums. I think that Bob guy got everyone thinking it was a Samsung batch, but he probably got his last month of something, so that's kind of misleading to people. Even though you shouldnt base your order on customer reviews in the first place, it's still misleading.
about 5 minutes... had to talk to two different people. they only seemed willing to listen when i expressed my willingness to buy a different/more expensive card. listen, i like newegg as much as anyone here, but i don't take lightly spending my hard earned money on something and not getting what i payed for. especially when you are ordering online and are at the mercy of a company 3,000 miles away. it takes me two weeks worth of work to pay for this card, so its not as though i am just some kid sitting around letting my parents pay for everything. i just wanted to be treated fairly, which after a little exasperation on the phone, I feel that I was. I am satisfied with my situation, but I am not satisfied that newegg after receiving knowledge of this (what i think is an oversight) error, they have not resolved it for all the other people who will soon be in my shoes.
So what's the best way to return it if need be (which probably will be)? Go through the Newegg RMA request thing? Call em' up?
Edit: Whoop, package just arrived. I'll let you know what it is though they're probably won't be any surpises.

i called, talked to a guy named john who seemed less than curteous, but he took care of me so I can't complain too much.
Yeah, i got a black PCB...i'm not sure how to check what kind of Ram it has...where does it say that? I probably don't even have to check it anyways.
just look at the ram, the brand will be readily apparent
