Along those lines: Things (or something else, hehehh) happen(s). I judge companies in how they handle issues almost more than I judge them for prices, etc....looking at this whole post is seems like the big deal was made of newegg BEFORE they had any opportunity to redress things - which, as they usually do, was readily acomplished.

Not so much that it happened here, but I wonder what really happens more often: Companies with lousy service or companies forced to adopt restrictive policies due to customer chicanery.

Well I think i'm going to have to keep this card, since shipping it back and paying a 15% restocking fee would kill the deal no matter what, so i get screwed on hardware again, just like i always do =p. Though Newegg will have to do without my buisness from now on.

I was hoping just to be able to do the flash bios thing, but i guess i'll have to try and OC it, which i don't wanna do. Like i said, i have bad heat probs as it is. So even if i do get to pro speeds, it'll probably put a lot of stress on the card, which i don't wanna do either.

Yet the card is still listed on their website as an ATI OEM card (although it is out of stock, so no one will be buying). That's the main issue here, the fact that they are selling a Sapphire OEM card that is not only mislabeled as an ATI OEM card but has misrepresenting pictures of an ATI OEM card. The red PCB vs. the black PCB makes all the difference; the red PCB is a real 9800 PCB, the black is the 9700 PCB. After all, the Sapphire OEM 9800Pro is the same thing - 9800Pro components and clock speed on a 9700Pro PCB. And that is designated correctly on newegg's site.

I like newegg and always order my stuff from there, but it would be disappointing to me if anyone who ordered the 9800np in the last few days was not given a full refund. Charging 15% restocking fee on a mislabeled and misrepresented item is what most disreputable pricewatch companies do and is totally beneath newegg's reputation.

Oh, and cheers SharkyExtreme users, first post here. I herald from XtremeSystems, where this thread was linked. I am very glad that people posted this information quickly; just today I had recommended this card to two friends who needed new ones for FFXI... so thank goodness I found out about the PCB issue.

I think you have a false impression. Increasing you core/memory with a program like powerstrip is far safer than flashing your BIOS. Flashing your BIOS increases your core/memory speeds, as the software does, and can do additional things like increasing some of the voltages you supply to parts of the card.

That said, I flashed my R8500lele from 230/230 to retail 275/275 a year and a half ago with no problems.

Don't get me wrong - if the card WAS misrepresented, and by now I'm sure it was (I have to admit some of the evidence posted confused me) then newegg should return it - free with shipping. I just didn't like hearing the initial 'fraud' accusations even before newegg was contacted. In fact, I personally believe that, even though there's no way this'll happen, that Titus, in a way, should get a better card than his original order. See, he gets a refund so he's back to where he started. EXCEPT for the inconvenience caused, however innocently, by newegg.

It's alot like one Burger King episode I had once. I ordered a meal and I got everything right except the burger. So I take it back in and explain and like newegg the guy starts my new burger on the grill and I watched as the guy took my perfectly good burger and toss it into a trash can. I mean I hadn't even taken a bite of it. I was happy that they took it back as of course they should have, but I think I should have been allowed to keep my original burger too. Same instince here. He should get a 9800 Pro for their mistake. Unfortunately like the Burger King guy companies often do NOT think like I do:( I was at a reteraunt once where my family got free drinks because the waiter forgot to put them on the order. If everywhere was like that he'd have a 9800 Pro coming his way:)

So what you're saying is we should be able to keep the card we have now, and be able to get a refund to buy a new one with?...:confused:. Sounds good to me :p, but it's not like the situation here... at least i don't think so.

while i would like a free upgrade and free shipping back to newegg... i am more than satisfied to have gotten the situation resolved. i think i have explained enough why i thought fraud could have played apart in this, while i think i was careful enough not say it indeed did, as always newegg has come through.

while i did not even bother asking for anything more than a refund i was happy to get a refurb. BBA Ati 9800 Pro for $255. now i am defintely crossing my fingers on this one.. but hey i like to live dangerously and possibly make huge mistakes. but at least this time if a mistake is made it will hopefully be mine, and not a company that is 3,000 miles away.

i am glad to hear that maybe this whole episode may have benefitted someone (surely not me cause i am out a total of $15 bucks). thats the good thing about forums at least they give us access to quick information.

i did speak to someone from newegg earlier this evening and impressed on him the urgency of changing their website. not sure if they sold out or are fixing their mistake, he told me that they would have it fixed by tonight.

adaman, if i were you, (i guess in a way i was you) i would do what felt was right, there was no way i could live with this situation. for me it was less about the performance of the card, and more about me getting what I paid for. they are still good cards, perform respectively.. in my experience near 9700 pro levels, but that was not what i paid for. if you feel like this is a situation that you can live with that don't sweat it, its still a good card and going to give you a good many months if not a year or more in current and future games. if you are like me and want only what you feel like you deserve and paid for, and feel like newegg should live up to its responsibilities than by all means hold them to them.

edit: one thing i wanted to add, newegg is not the bad guy in this. they have proven that to me by handling it with class. they are a company run by people, and people being what they are they are prone to mistakes. it is how they handle those mistakes which determines how good a company is. i had enough confidence to order from the again today and i would have enough confidence to order from them in the coming weeks. i respect that company a great deal and appreciate their willingness to do what is right by their customers.. there are quiet allot of companies out there for which the same things could not be said. by saying they should be held to their responsibilities i am not suggesting that they will not hold themselves to those same responsibilities, as they have shown a propensity to such actions. I'm still sorta considering it. Since i didn't ship it out today i'll have to wait till Monday anyways, so that should give me some time to think. Not getting what i paid for doesnt sit well with me though, but i'm kinda damned if i do, and damned if i don't.

Well, if you mean ONLY a 9800Pro, maybe. If you mean a 9800Pro AND his present card, I don't think so. It's a matter of degrees. A second burger or a few drinks is a lot less than a vid card.

Honestly - how much better would it be?? I know there are issues, but ***t does happen - and they resolved yours fairly well. I know there's still that 9800 deal, but.......

yeah, i am happy with the resolution I got. i maybe got alittle too hot under the collar about this whole thing, but to me $249 is a big deal. all is well in my universe, just hope this doesn't happen to others.

I was just wondering if people could OC these cards without any problems, but it sounds like people are getting artifacts pretty quickly.

Newegg said i can only exchange my 9800 for the same exact one, or one of a higher price...so i'm still kind of screwed there. Next thing up i'd go for would be the Powercolor, since i want something more guaranteed. Doesn't seem like it'd be worth the $70+ though =/

My 9800 from newegg is waiting for me at my doorstep (Im stuck at work till 6:00 pm pacific)

Im pretty sure it will be the black pcb version. Im also sure that newegg will be closed by the time I get home.

So I will have a whole night to stare at this card. It will be very hard to resist throwin it in to see what it can/can't do.

I guess what Im wondering is: will newegg give me any kind of extra leverage for a return if they can tell that I've never used the card? (as in it could still be sold as new)

tituswolf: do you have any suggestions on what to say to newegg? I don't really want a 'refurb' in replacement, I would prefer a refund. Did they give you that option as well?

Just put it in and use it. Some people are really anal. Then there are normal people. I'm sure it will work real nice, and play games good too. Don't even run a benchmark, it might be 2 or 3 points lower than you expect, then it becomes a big hassle for you and for everyone.
