Trade Gone Bad- I want my speakers or a refund...

I'm not trying to start a flame war or a name calling bout. I'm posting this thread in an effort to get what I feel is rightfully mine and to let others know of my difficulties in hope to avoid future problems with trades.


Ok here's the deal:


Back on March 29th I contacted Azn4sportz in response to his For Sale ad (http://www.sharkyforums.com/showthre...hreadid=123001) about a pair of Altec Lansing ACS33 Speakers he was selling for $30. They are usu. around $50new these were $30used. I contacted him and he was quick to respond and work out the details with me. He gave me the addy to send paypal to and I sent it that day (3-29-02)

No problem.. payment accepted and the waiting game began. On April 5th(7days later) I hadn't heard anything yet so I sent an email asking if he had gotten the payment ok and if/when it was shipped. This is where it gets fun: Got a response back saying that the email addy (from the paypal receipt) was not the sellers email. He had in fact used his friends Paypal account to make the transaction. But the friend said that he had gotten the $$ and would pass along my message.

4 days later I get a message from the seller saying that it was in the mail.

on the 15th of April - still no sign so I sent another email asking how it was sent etc. I got no reply. bugged his friend again and it began to be like pulling teeth to get a response. None of which were over a few words long and never answered exactly what I had asked.

We carried on like this for a while.. I would send an email trying to get specific info and he would wait several days to reply and then his replies wouldn't answer my questions. i would reply to that and ... you get the picture. poor communication.

and me.. no $$ and no speakers.
Then I got a strange PM that was extremely cryptic- but basically asked if I was the one who bought the speakers.. I think.. VERY cryptic. I PM'd back- no reply.
Next I got an angry email asking me if I was pulling a hoax because he had read about people that would say they never got their order just to ruin someone and try and get free stuff and he was 'pretty sure' he mailed the package and he wanted me to 'stop bugging' him and go away.

Sent off one last email (probably 6-7 over the month -is that bugging?) which was basically a rebut. saying that I was sorry he thought I was trying to scam him but his emails and PM were cryptic and never answered my questions thoroughly nor did I ever get the product. And how could he be 'pretty sure' he sent it.. he either did or he didn't. And that was it.

Another email (now over 1 month passed) telling him I either wanted a refund or the speakers I paid for and he begged for more time(maybe they're lost in the mail).. I gave him close to another week. Still no sign.. Told him the deadline was up and restated my case.
He said he'd give me 1/2 of what I paid him.

I asked for advice from on Anandtech(http://forums.anandtech.com/messagev...ighlight_key=y)((I'm under 'ripthesystem' on that forum)) and everyone agrees it is the Sellers responsibility to make the trade go right. They suggested I contact the Trollhunters and the Mods here and I have done both and the TH suggested that I go public here.

He hasn't responded to my latest email and no speakers and no $$.
I see however that he is still actively trading on the board and I want others to be aware of the situation.

Hopefuly you used a Credit card throu paypal???

If so just contact your CC company and have them snatch your money back out of his paypal account. :) That will get his attention.

Used non-CC funds via Paypal so there won't be any snatch back- thought that would've been a great idea.

I replied to his last email. I have done many trades on this post. I offerd back half of the money but he did not accept. I paid $20 for shipping.

actually you have NOT replied to my last email-either from Wed or Thurs(not sure off the top of my head) and yes you said you would refund half.. you also told me that shipping cost you $15.

I don't care what the cost of the shipping is. I want what I paid you or the product I paid you for. I don't want half of my money back or half a set of speakers. I want ALL of what I paid you for- That is fair.

It is the sellers responsibility to make sure the product gets to the buyer as advertised.

it's you're fault they didn't get to him. until he actually puts his hands on the speakers, you're responsible for them. if you paid $20 for shipping, you should have got a tracking number so that you would know at all times where they are, if they were delivered, who received them, etc. That way if they were misdelivered, you could go after UPS or whoever for compensation. But you can't charge him half his money for a product he never received.

azn4sportz is a good trader on these forums. Black....and the rest of you, should know better than to publicly go after him. this isnt a public matter. its between the buyer/seller

Awww, but it does have to do with us because azn4sportz is selling items here in SF and how he deals with his buyers is important information for anyone who is planning on buying from him. That's why ebay has Seller Reviews, so others can tell you what kind of experience they had when dealing with a seller.

Personally, I think azn4sportz should track the package that he sent. If he lost the tracking number than it is his fault for not following up on his order and should refund IN FULL to big black. Serves paid for serves rendered.

since I am shopping for a new PC and trying to part things out this is the kind of information I am greatly interested in. Dont bash the man for trying to protect the rest of us

I think this should be public. If the speakers went bad (which can happen quite easily) then azn4sportz refunded in full he would be a great person, now by pulling this he has basically ruined his own reputation and will most likely never be able to sell anything here again. It is his own fault and big black is right to try and protect us and get his money back.

Thanks for all your input and support. KegCanMan I totally understand your reservations about going public with this matter. I have however been trying privately for almost 1 1/2months to resolve this in a private fashion.

Only after I had exhausted every other option did I go public (and with the support and encouragement of the TrollHunters). I did not bring this up to ruin anyones reputation.. I merely want what is rightfully mine and to let others know that this person, who may be a great seller when things go right, does not want to own up to his own responsibility when things go wrong.

Everyone here that is trading has a right to know this..
