"Practically new" IS NOT new. If they are selling it as a 100% new unused part & they send me a used or opened item intentionally - that is illegal. (I know I'm an attorney.) So the point is, if they want to sell me a part that someone else has fiddled with, they should tell me up front,& let ME decide wether or not a used or "practically new" part is worth my hard earned $$$.
And as for their return policy, that is their choice of business (and a big reason they do well.) That, I repeat, is their choice, NOT mine. So in effect, THEY are reaping what THEY sow. If they can't handle having so many returns that work perfectly fine, then change the policy. That is perfectly legal. Selling me a part that has been used (although in "like new" condition) while claiming the part is new is a lie and perfectly illegal.

Please use the provided quote feature if your going to quote someone.
And can you please show me WHERE it says that sending you that part is illegal. And you have understand, that they can't really verify whether or not a part has been "fiddled with" unless its really obvious. They can only verify that the package has been opened. Unless of course the persons states in their RMA request that they did use it. However if you OC the stuffing out of a processor, decide you dont like and ship it back as DNU (Did Not Use). Then, its never been "fiddled with" as far as I know.
I mean think about this in terms of the car industry, to draw a parallel. Ever "new car" on that lot already has like 50 miles on it from testing and transport. And God only knows how many people have sat in it or test drove it. Now if you walk into a stealership and ask for 'that' car but 'new' there going to point you to Factory rep who is going to charge you for custom order. Those are usually about 1.5X more expensive then if you had driven off with the New Car at the lot.

How about Gamestop not taking returns anymore for the same reason people always want to return **** to us but NOooOOooo I cant buy that Capcom Vs SNK as new if someone had it for 3 days even if its flawless and scratchless!
So they sue gamestop and whoopiedoo for 3 weeks everyone that has a recipt for the time's we took returns can get 15% off a purchase, hell thats less than the employee discount!
oh ya and Gamestop no longer lets people return New games, so who really takes it in the rear? Those of you who get stuck with a shitty game and no recourse! (not me I get to check games out =P im safe)

If we want to get into a moral dilemma then it's not right to accept something like that. If you call them up and they say just keep it then it's fine, but stupidity has nothing to do with keeping something you weren't supposed to get.

True, But how does one tell the difference between used and new? I have seen used items that looks perfectly new...
So if they assume it is used, they have a reason for it.. Either it be a Demo model, return, or whatever.. Even if the user NEVER opens the box.. They by law have to mark it as used.. That is why there is a restocking fee

I guess when I posted this thread I should have stated 'parts that are obviously used'. Scratches, mucked up greasy manuals or parts, etc. Guess I figured everyone would know what I was getting at.

I agree there, but think about it. Getting a mobo which has an opened package, but is otherwise pristine and in perfect working condition, thats great and more like your Car analogy. However, some of these people are getting mobos with dirty fingerprints on them and without the batteries, and in the Video & Screens forum, some dude got his monitor shipped in with dents all over the box, now getting back to the analogy, imagine getting your car with dirty fingerprints (think, mechanic's fingerprints with oil and grime) all over your leather interior. Or how about buying a new car without the battery, or buying a car with a dent in it, thats ****ing crazy right there. Im not disagreeing with you Isezumi, and I am not agreeing with the goddamn attorney either, what teh ****, but you have to admit it is disconcerting to know that your 'supposedly new ****' may have been ****ed with.

Honestly,
There are few distinctions you have to make clear.
A: People make mistakes (ref. missing battery). It happens, resist the urge to pull your hair out by the fistful, call them back and ask them why your "new" motherboard doesn't have a battery.
B: Dirty Finger prints only mean the unit has been HANDLED. You can not base a "its used" arguement off of just dirty finger prints alone. I mean how does your arguement hold up if your board has dirty prints on it, and you just walked out of Will Call from the factory?? People have hands, they get dirty. It happens.
C: Malformed packaging Materials also dont mean anything. Remember there is INTERMEDIARY party between when Newegg sends a box off and you have it in your hands. It's not Neweggs fault if some College Kid workin the belt gets careless. However if whatever you have inside your package still works as it should, the carrier isn't really going to care whether there is a dent in the box, CAUSE ITS A BOX!!! they cost like $.08 in bulk. In a purely economic sense, assuming the item inside the box works perfectly, your WASTING more money caring about the box then the box is worth (even with all the print on it).
Let me tell you a secret about people...They have a REALLY bad habit of making histrionic statements when they have been wronged. It similar to "Tall Tales", a few finger prints turn into "A lot of finger prints" into "giant greasy, smudgy finger prints everywhere". People who get bumped or nudged will eventually end up being knocked flat on their as$ if left to dwell on it long enough. Now I am not going to tell any specific person that they are lying...cause WE DON'T KNOW THE WHOLE STORY. But a majority of people do act like this, and I can tell you from personal experience in Customer Service this is dead on correct 90% of the time. And the person on the other end of the line knows this too. The phrase "Customers will do anything to get their money back" is pretty much burned into your mind by the time you are done with your training. And if the first thought in your mind after reading that is "No, I don't." your worldview is too narrow.

I have ordered $21,000 worth of parts from NewEgg since 9/7/2001 (60 total invoices). If anybody has done more business with NewEgg than me, step up.
I have never been sent a used part from them. HAve I gotten parts that didnt't work? Sure - but that's quality control from the manufacturer - all a vendor can do is ship out the parts they buy from the manufacturers. I will say this about NewEgg:
1. Exceedingly fast shipping. As in, mind-boggling. Every time. (see # of invoices above).
2. High-quality parts - not ever a used part.
3. Generous RMA policy and fast turn-around. I don't believe I have ever been denied an RMA replacement or refund with them.
4. Very good selection. Very good prices.
5. In general, top-notch service.
Do I do business with other vendors? Yeah, but not nearly as much anymore. I still occasionally buy from Directron and Nexfan, which I also highly recommend. But NewEgg takes the cake.

I just received a rather large shipment from newegg yesterday (90% of the new system in my sig) and everything was brand new and so far flawless. This is about my fourth order with them now, nothing wrong yet that hasn't been quickly corrected (A sealed motherboard was DOA, RMAed and new one was had in less than one week). So as far as I'm concerned, newegg gets two thumbs up from me
